- Discuss the Indian Judicial Service (AIJS).
On Constitution Day, the President had stressed on the need for an All India Judicial Service to reflect the diverse composition of India in the judiciary. The idea of AIJS to streamline the recruitment process for judges has been a subject of long-standing debate and controversy in legal circles.
- Indian Judicial Service (AIJS):
- Objective: To select and nurture talented individuals across the country and to ensure representation from under-represented social groups. That is, the Indian Judicial Service is to enhance judicial efficiency, speed up recruitment and ensure uniform training..
- Need for AIJS
1. Vacancies: There are about 5400 vacancies in the lower judiciary and there is a backlog of 2.78 crore cases.
2. Quality concerns: The declining number of judicial officers affects their quality.
3. Financial incentives: State services often fail to attract top talent due to low salaries.
4. Training and subordination: There is a lack of adequate training resources; current appointments are marred by subjectivity and nepotism.
5. Nepotism: Nepotism has emerged as a major problem in the judicial service. This can help in reducing the prevalence of corruption.
- Problems with the Indian Judicial Service
1. Federalism: AIUS is seen as an infringement on the powers of the states.
2. Language and representation: Centralised recruitment under this can affect the use of regional languages.
3. Structural Issues: AIDS cannot solve systemic problems like low salaries and inadequate infrastructure
4. Bureaucratization: Centralization of recruitment does not inherently guarantee efficiency.
Thus, the Indian Judicial Service is capable of solving many of the judicial problems of the present time. If the problems in it are properly identified and removed, it can prove to be helpful in ensuring social justice in the country, a strong economy and realizing the idea of a developed India, which has also been recommended in the Strategy for New India @75′ report of the NITI Aayog.
